CLAP TERMS OF SERVICE

1) Who can use Clap

  • 18+ only. The Services are for individuals age 18 or older. By creating an account, entering a challenge, or claiming a prize, you represent that you are at least 18.
  • Eligibility & local law. Participation and prizing are void where prohibited. You are responsible for ensuring you are eligible under your local laws. We may withhold, revoke, or require return of any prize if you are found ineligible or cannot verify eligibility.
  • No professional advice. We are not a medical provider or safety authority. Consult a qualified professional before attempting strenuous or unfamiliar activities.

2) Accounts, verification, and payouts

  • Account accuracy & security. Keep your information accurate and your account secure. You are responsible for all activity under your account.
  • Age self‑attestation. You must confirm that you are 18+ at sign‑up and before participating in physical challenges.
  • Prize verification. We may require identity and eligibility verification (e.g., government ID) and tax forms (e.g., IRS Form W‑9) before awarding any prize or when your total prizes in a calendar year approach applicable reporting thresholds as required by law. Failure to provide requested information may result in forfeiture.

3) Challenges, rules, and judging

  • Official Rules. Each prize challenge includes “Official Rules” that supplement these Terms and govern eligibility, entry limits, judging criteria, prizing, and delivery. If these Terms conflict with the Official Rules, the Official Rules control for that challenge.
  • Skill‑based contests. Clap challenges offering prizes are intended to be skill‑based (not chance). We may limit or suspend prizing for formats vulnerable to cheating (e.g., static‑question trivia) until anti‑cheat and dynamic question banks are in place.
  • AI judging with human review. Entries may be scored by automated systems and/or human reviewers. We may correct scores or disqualify entries for suspected cheating, unsafe conduct, or technical anomalies. Our determinations are final.
  • Right to refuse/disqualify. We may, in our sole discretion, refuse, remove, or disqualify any submission for any reason, including off‑topic content, unsafe or unlawful conduct, suspected fraud or collusion, policy violations, offensive content, corrupted files, or technical errors. We may also void any prize affected by such issues.

4) Safety and physical‑activity disclaimer

  • Safety Code applies to physical challenges. We may present an in‑app Safety & Conduct Code interstitial before any physical challenge. Even if the in‑app interstitial is not shown, by participating in any physical challenge you confirm you have reviewed and agree to the Safety & Conduct Code available at clap.gg/safety.
  • Assumption of risk & release. Physical challenges involve inherent risks (e.g., injury, property damage). By participating, you voluntarily assume all risks and agree to follow all safety rules and applicable laws. To the fullest extent permitted by law, you release and hold harmless Clap, our affiliates, and personnel from claims arising out of your participation, except to the extent caused by Clap’s willful misconduct.
  • Prohibited conduct. No dangerous locations or behavior (e.g., driving, rooftops, weapons, trespass), no illegal acts, no harassment, no recording non‑consenting people, and no impersonation. We may remove content or suspend accounts for violations.

5) Your content (UGC) and publicity

  • Ownership. You retain ownership of the content you submit (videos, audio, images, text, etc.).
  • License to operate the Service. You grant Clap a non‑exclusive, worldwide, royalty‑free, transferable, and sub‑licensable license to host, store, process, transmit, reproduce, display, perform, adapt, and moderate your content to operate, secure, and improve the Services, enforce our policies, and promote the Services (e.g., in‑product showcases and Clap‑owned channels).
  • No model‑training (now). We do not use your content to train our own machine‑learning models at this time. If we ever want to do so, we will seek your affirmative consent first (opt‑in control).
  • Likeness & publicity. You grant us permission to use your name, image, likeness, and voice in connection with the above uses. You may opt out of promotional featuring where feasible (see Privacy Policy).
  • Private vs. public clips. You can mark a clip Private; private clips are excluded from marketing use unless you later opt in. Clips marked Public or otherwise flagged for featuring may be showcased.
  • Deletion. If you delete content or your account, we will remove it from public view. Backups and cached copies may persist for a reasonable period, and content already included in completed materials (e.g., highlight reels) may continue to appear.
  • DMCA. We comply with U.S. copyright law. See Section 12 for our DMCA policy and how to submit notices.

6) Payments, prizes, and fulfillment

  • Fees & prizes. Any entry fees and prize details are disclosed on the challenge page and/or in the Official Rules.
  • Fulfillment. Prizes may be fulfilled by Clap or by a third‑party sponsor/creator named in the Official Rules (each a “Sponsor”). Clap may assist with administration but is not responsible for a Sponsor’s failure to deliver. We may require winner verification and compliance with all rules before delivery. Taxes are the winner’s responsibility.

7) Service availability; bugs; sole remedies

  • As‑is / as‑available. The Services are provided “AS IS” and “AS AVAILABLE.” We do not guarantee uninterrupted service, recording, or error‑free judging.
  • Exclusive remedy. If a submission is lost, delayed, corrupted, misjudged, or otherwise affected by a technical or administrative issue, your exclusive remedy is, at our discretion, re‑submission, a re‑entry credit, or restoration of access.

8) Liability limit and allocation of risk

  • No consequential damages. To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, exemplary, or consequential damages.
  • Cap. To the fullest extent permitted by law, Clap’s total liability for all claims relating to the Services shall not exceed the greater of $100 or the amounts you paid to Clap in the six (6) months before the claim arose.
  • Peer disputes. We are not responsible for disputes between users or between users and Sponsors; such disputes are solely between the parties involved.
  • Indemnity. You agree to indemnify and hold Clap harmless from third‑party claims arising from your content, your conduct, or your breach of these Terms.

9) Intellectual property; platform rules

  • Don’t infringe others’ rights. Don’t reverse engineer, scrape, or misuse the Services. We may remove infringing content and suspend repeat infringers.

10) Termination

  • We may suspend or terminate your access for violations or risk to others. Upon termination, your obligations that by their nature should survive (e.g., licenses to the extent necessary, disclaimers, limitations of liability, arbitration) will survive.

11) Disputes; arbitration; class waiver

  • Informal resolution. Before filing a claim, you agree to email hey@clap.gg with a brief description and allow 60 days to attempt resolution.
  • Binding arbitration. Any dispute that cannot be resolved informally will be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. Either party may bring an individual claim in small‑claims court.
  • Class‑action waiver. You and Clap waive any right to a jury trial or to participate in a class, consolidated, or representative action.
  • Opt‑out. You may opt out of arbitration within 30 days of accepting these Terms by emailing arbitration‑optout@clap.gg with your account email and a clear statement that you opt out.
  • Governing law. Delaware law governs these Terms, without regard to conflicts of law, except that the AAA rules and the Federal Arbitration Act govern arbitration.

12) Copyright complaints (DMCA)

Send notices of claimed infringement to DMCA Agent, Clap, 1908 E 8th St, Austin, TX 78702, USA; dmca@clap.gg. Your notice must meet 17 U.S.C. §512(c)(3) requirements. We may terminate repeat infringers.

13) Changes to these Terms

We may update these Terms from time to time. If changes are material, we will provide reasonable notice by posting to the Services or contacting you. Your continued use after the effective date constitutes acceptance.

OFFICIAL RULES

1) Sponsor; Administrator

  • Sponsor: [Name, Address].
  • Administrator: Virtual Playgrounds, Inc. d/b/a Clap (“Clap”) may assist in administering the challenge.

2) Eligibility

  • Open to legal residents of the United States who are 18 years or older at time of entry. Employees, officers, directors, and household members of Sponsor and Clap are not eligible. Void where prohibited.

3) Challenge Period; How to Enter

  • Entry window: [Start Date/Time] to [End Date/Time] [local time].
  • How to enter: Follow the in‑app instructions for the challenge. Limit: [N] entries per person/account unless otherwise stated.

4) Skill‑Based Judging Criteria

  • Entries are judged according to the following objective criteria (weights in parentheses): e.g., Accuracy (40%), Speed (30%), Creativity (30%).
  • Judges may include automated systems and qualified human reviewers. Sponsor/Administrator decisions are final.

5) Anti‑Cheat; Disqualification

  • Prohibited: collusion, multiple accounts, automation/bots, tampering, or attempts to exploit bugs. Sponsor/Administrator may disqualify any entry and may void affected prizes.

6) Winners; Notification

  • Potential winners will be notified via in‑app message or email within 7 days after the Challenge Period. A potential winner must respond within 72 hours (or as stated) or an alternate winner may be selected.

7) Verification; Taxes

  • Sponsor/Administrator may require verification of identity (government ID) and eligibility, and completion of tax forms (e.g., IRS Form W‑9). Prizes are taxable; winners are responsible for all taxes and fees.

8) Prizes; Approximate Retail Value (ARV)

  • Prize(s): [Description and ARV]. Prizes are not transferable or substitutable except at Sponsor’s discretion.

9) Publicity; Content License

  • By accepting a prize, a winner grants Sponsor and Clap a limited right to use winner’s name, image, likeness, and entry for winner announcements and prize fulfillment, as permitted by law.

10) General Conditions

  • Sponsor/Administrator may cancel, suspend, or modify the challenge if fraud, technical failures, or any factor impairs its integrity or proper functioning. If terminated, Sponsor may select winners from eligible entries received up to the time of action.

11) Limitations of Liability; Release

  • By participating, entrants agree that Sponsor, Clap, and their affiliates are not responsible for lost, late, misdirected, damaged, or corrupted entries; network/technical failures; or any injuries or damages arising out of participation. Entrants release Sponsor and Clap from claims arising from participation or prize receipt/use, to the extent permitted by law.

12) Disputes

  • Disputes will be resolved pursuant to the arbitration provision in Clap’s Terms of Service. Delaware law applies, without regard to conflicts of law.

13) Winner List; Rules Requests

  • For winner names or a copy of these Official Rules, email hey@clap.gg referencing the challenge title within 30 days after the Challenge Period ends.

SAFETY & CONDUCT CODE

Before you start: Clap is about creative, fun, and safe challenges. Follow these rules every time.

Do

  • Choose a safe location with clear surroundings.
  • Warm up and know your limits; stop if you feel unsafe.
  • Follow all laws and posted rules (parks, private property, venues).
  • Use protective gear where applicable.
  • Get explicit permission before filming others.

Don’t

  • Don’t perform challenges while driving or operating machinery.
  • Don’t climb onto rooftops, ledges, or dangerous heights.
  • Don’t use weapons, fire, explosives, or hazardous materials.
  • Don’t trespass or disrupt public spaces.
  • Don’t harass, bully, or endanger anyone.

Tech & Integrity

  • No bots, scripts, collusion, or tampering. Don’t exploit bugs. Report issues immediately to hey@clap.gg.

Age & Eligibility

  • You must be 18+. Prizes are void where prohibited. We may require ID and tax forms before awarding prizes.

Enforcement

We may remove content, disqualify entries, or suspend accounts for violations. Serious or repeated violations may lead to a permanent ban.
